ENROLLMENT AGREEMENT, LIABILITY WAIVER, RELEASE, INDEMNIFICATION & PARENTAL CONSENT

SECTION 1: PARTIES
This Agreement is entered into by and between Nomadic Baseball LLC (“The Academy”) and the undersigned Parent or Legal Guardian (“Parent”), individually and on behalf of the participating minor student (“Student”). Parent represents that he/she has full legal authority to sign on behalf of the Student.
SECTION 2: PROGRAM DESCRIPTION
The Academy provides baseball training, strength and conditioning, recruiting guidance, camps, showcases, tournaments, travel activities, and related programming (“Activities”). Participation is voluntary.
SECTION 3: NO GUARANTEE DISCLAIMER
The Academy makes no guarantees regarding scholarships, college admission, roster placement, athletic improvement, or recruiting outcomes. Results depend on factors beyond the Academy’s control.
SECTION 4: ASSUMPTION OF RISK
Parent and Student understand participation involves inherent risks including but not limited to concussion, broken bones, heat illness, communicable diseases, travel-related injury, permanent disability, or death. All such risks, including those arising from negligence (but not gross negligence or intentional misconduct), are voluntarily assumed and accepted by both parent and student.
SECTION 5: RELEASE OF LIABILITY
To the fullest extent permitted under Arizona law, Parent releases Nomadic Baseball LLC and its owners, officers, directors, coaches, employees, volunteers, contractors, sponsors, agents, and affiliated facilities (“Released Parties”) from any and all claims arising from participation during Academy activities, including negligence, except for gross negligence or intentional misconduct by any of the released parties.
SECTION 6: TRANSPORTATION & TRAVEL
Parent authorizes Student to travel in Academy-arranged transportation, including staff, volunteer, or third-party vehicles. Parent assumes all risks related to transportation and releases Released Parties from liability except for gross negligence or intentional misconduct.
SECTION 7: MEDICAL AUTHORIZATION
Parent authorizes emergency medical treatment and accepts full financial responsibility for any medical costs incurred. The Academy does not provide health insurance coverage. Parents are required to provide proof and copy of the student's medical coverage.
SECTION 8: INDEMNIFICATION
Parent agrees to indemnify, defend, and hold harmless the Released Parties from any claims, damages, or attorneys’ fees arising from Student’s participation or conduct.
SECTION 9: ARBITRATION AGREEMENT
All disputes shall be resolved exclusively through binding arbitration in Phoenix, Arizona metro area administered by the American Arbitration Association. Parent waives the right to jury trial and class action participation.
SECTION 10: LIMITATION OF DAMAGES
Any recovery shall be limited to tuition paid for the current program year. Consequential or punitive damages are waived to the fullest extent permitted by law.
SECTION 11: GOVERNING LAW & SEVERABILITY
This Agreement shall be governed by Arizona law. If any provision is unenforceable, remaining provisions remain in full force and effect.
SECTION 12: ACKNOWLEDGMENT
Parent and Student acknowledge they have read and understand this Agreement and are voluntarily waiving certain legal rights.
